C. David Butler
 
David Butler has litigated bankruptcy cases in the southeast for over thirty years.  David comes to Shapiro Fussell as the past United States Trustee overseeing and protecting the integrity of the Bankruptcy Courts in Georgia, Florida and the Caribbean.  The U.S. Trustee plays an important role in the oversight of the bankruptcy process -- appointing and monitoring individuals employed to represent bankruptcy estates, including bankruptcy trustees and examiners, assessing the feasibility of plans of reorganization, reviewing and commenting on professional fees, moving in bankruptcy cases against irregularities, and investigating and assisting in the prosecution of bankruptcy crimes.

As private counsel David served as Examiner, Trustee and Committee Counsel appointed in many and varied cases. He has represented reorganizing and liquidating companies, boards and individual executives of larger, troubled companies.  He has also guided many financial institutions in the bankruptcy process, advocating the full protection and enforcement of their collateral and debt positions. Important engagements have included the representation of the Examiner in the largest Chapter 11 filed in the Region, and the out-of-court workout involving eight banks and Georgia's largest industrial corporation.  David holds the Region's record for the largest forced restructuring of a class of secured claims pursuant to the so-called "cram down" provisions of 11 U.S.C.  1129(b).  As a practicing attorney, David has been recognized as a bankruptcy specialist in every edition of The Best Lawyers in America (Naifeh and Smith).  David has been recognized in the Bankruptcy Court as an expert witness as to the reasonableness of significant professional fees awarded in bankruptcy cases.

David was a founding director and twice President of the Southeastern Bankruptcy Law Institute and his local bar's Bankruptcy Law Section.  A former President of the Atlanta Bar Association, and a fellow in the American College of Bankruptcy, David has authored and presented papers and lectured on varied bankruptcy topics at seminars and classes offered by the Atlanta Bar Association, the American Bar Association's Division of Professional Education, The Emory Law School and its Law Journal, the Florida, Georgia and Puerto Rico Bar CLE Programs and other seminar groups sponsoring debtor/creditor issues. As U.S. Trustee he served on the National Director's Advisory Committee and participated in the design and presentation of seminars for Department of Justice attorneys and staff.  In 2005, Mr. Butler received the Atlanta Bar Bankruptcy Law Section's Pollard Achievement Award for sustained contributions toward professionalism and ethics.  Mr. Butler currently serves as Chairman of the Atlanta Bar Association's Judicial Campaign Conduct Committee.
