The Firm actively engages in representing creditors and debtors
in bankruptcy proceedings. This representation includes appearing
on behalf of creditors and debtors in Chapter 7 liquidation
and Chapter 11 reorganization proceedings, preparation of administrative,
secured and unsecured claims for creditors (including construction
lien claims that must be coordinated with state lien law); prosecuting
and defending motions to lift stay and adversary claims in Bankruptcy
Court, litigating commercial disputes in bankruptcy proceedings,
and resolving issues related to ongoing executory contracts
impacted by a debtor's bankruptcy filing. The firm also represents
creditors and debtors through loan workouts and debt restructurings
that are prevalent in the construction industry, particularly
where creditors and/or debtors desire to avoid certain adverse
consequences associated with bankruptcy proceedings including
possible preference claims, loss of management control or added
exposure to liability of individual shareholders or principals.
The firm has also been called upon to represent creditors' committees
and trustees assigned to bankruptcy cases, and other parties
in interest in bankruptcy related matters. |
